Ce dernier est entendu comme un mod\u00e8le informel, model\u00e9 par Institutions europ\u00e9ennes \u00e0 la suite de l\u2019activation de la politique commune de l\u2019investissement, et compl\u00e9t\u00e9 par la proposition de la Commission du 12 novembre 2015 effectu\u00e9e dans le cadre des n\u00e9gociations du TTIP.<\/p>\n<p class=\"01bCorpsdetexte\">Par l\u2019\u00e9tude des points de friction entre le droit de l\u2019Union et le droit international des investissements, et par une comparaison des propositions d\u2019accords TTIP, CETA, UE-Vietnam et UE-Singapour avec les trait\u00e9s bilat\u00e9raux d\u2019investissement des \u00c9tats membres, mais aussi ceux des \u00c9tats-Unis et du Canada, ainsi qu\u2019avec le TPP, l\u2019auteur d\u00e9gage les caract\u00e9ristiques du mod\u00e8le europ\u00e9en d\u2019accord d\u2019investissement et en \u00e9tudie la port\u00e9e.<\/p>\n<p class=\"01bCorpsdetexte\">Il appr\u00e9cie ainsi l\u2019\u00e9tendue des comp\u00e9tences de l\u2019UE en mati\u00e8re d\u2019investissements \u00e9trangers, puis v\u00e9rifie la compatibilit\u00e9 du r\u00e8glement des diff\u00e9rends investisseur-\u00c9tat avec les r\u00e8gles de l\u2019ordre juridique de l\u2019Union. Il d\u00e9crit ensuite le positionnement du mod\u00e8le europ\u00e9en quant au niveau de protection absolue et relative conf\u00e9r\u00e9 \u00e0 l\u2019investisseur tout en mettant en valeur l\u2019extension de la reconnaissance des droits de la puissance publique op\u00e9r\u00e9e par les accords. Il caract\u00e9rise enfin les modifications apport\u00e9es au r\u00e8glement des diff\u00e9rends investisseur \u00c9tat, notamment par l\u2019ajout d\u2019un m\u00e9canisme de nomination des juges par les Parties \u00e0 l\u2019accord et d\u2019un syst\u00e8me d\u2019appel avant d\u2019en mesurer la port\u00e9e sur le syst\u00e8me multilat\u00e9ral.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Abstract<\/strong><\/p>\n<p class=\"01bCorpsdetexte\">This article analyses the features of the EU\u2019s Investment Agreement Model. This Model is considered as an informal one, shaped by the Institutions following the activation of the Common Foreign Investment Policy, and completed by the Commission\u2019s proposal for investment protection and an Investment Court System made in the framework of the negotiations of the TTIP and published on November 12, 2015.<\/p>\n<p class=\"01bCorpsdetexte\">The author draws the characteristics of this new EU Model by studying the sticking points between EU Law and international investment law, and by comparing the drafts of the TTIP, CETA, EU-Vietnam and EU-Singapore agreements with the bilateral investment treaties of the EU Members states, the United States, Canada and with the TPP.<\/p>\n<p class=\"01bCorpsdetexte\">He formulates a hypothesis on the scope of the competence of the EU on foreign investment, and checks the compatibility of the investor-State dispute settlement mechanism with the EU legal order. He describes the position of the EU Model regarding the investor\u2019s absolute and relative protection, and highlights the recognition by the drafts of an extended right to regulate in favour of the State.
