Traditionnellement, il implique qu\u2019une juridiction p\u00e9nale ne peut r\u00e9examiner la chose jug\u00e9e par une autre juridiction r\u00e9pressive d\u00e8s lors que le jugement est devenu d\u00e9finitif. Ce droit fondamental de l\u2019accus\u00e9 est garanti \u00e0 la fois dans le cadre du droit europ\u00e9en des droits de l\u2019Homme, au titre de l\u2019article 4 du Protocole n\u00b0 7 \u00e0 la Convention, et du droit de l\u2019Union europ\u00e9enne, au titre de l\u2019article 50 de la Charte des droits fondamentaux de l\u2019Union europ\u00e9enne et de l\u2019article 54 de la Convention d\u2019Application de l\u2019Accord Schengen. Soumis \u00e0 l\u2019interpr\u00e9tation des deux cours, il invite \u00e0 r\u00e9interroger la notion de \u00ab dialogue des juges \u00bb. L\u2019objet de cette contribution est ainsi d\u2019\u00e9tudier la port\u00e9e du principe ne bis in idem au sein des deux syst\u00e8mes juridiques en interrogeant la mani\u00e8re dont ces juridictions ont pu interagir en la mati\u00e8re. En particulier, il s\u2019agit d\u2019analyser la mani\u00e8re dont chacune des cours reprend, s\u2019inspire ou \u00e9carte les principes d\u00e9velopp\u00e9s par l\u2019autre. En effet, la prise en compte de la jurisprudence ext\u00e9rieure peut \u00eatre assum\u00e9e ou silencieuse ; elle peut aboutir \u00e0 la convergence ou \u00e0 la distinction. Or, il semblerait que la diversit\u00e9 des questions d\u2019interpr\u00e9tation soulev\u00e9es dans le cadre de la d\u00e9termination de l\u2019idem et du bis pr\u00e9figure un dialogue \u00e0 plusieurs visages.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Abstract<\/strong><\/p>\n<p class=\"01bCorpsdetexte\">Ne bis in idem is a classic principle of criminal procedure which comes from Roman law. It traditionally implies that a criminal court may not re-examine a final decision according to the res judicata principle. This defender\u2019s fundamental right is guaranteed by both European law on Human rights and European Union law, under article 4 of the Protocol n\u00b0 7 to the European Convention for the former and under article 50 to the Charter of Fundamental Rights of the European Union as well as article 54 to the Convention implementing the Schengen Agreement for the latter. It therefore invites to take another look to the concept of \u201cjudicial dialogue\u201d. The purpose of the paper is thus to study the scope of the principle in both legal systems by questioning the way the courts have been interacting on the matter. It is especially focused on the way each court have been using or rejecting the principles set out by the other one. As a matter of fact, the consideration of external case law can be assumed or silent ; it can result in convergence or differentiation.
