Il s\u2019agit de r\u00e9fl\u00e9chir sur l\u2019effectivit\u00e9 du dialogue juridictionnel en tant que facteur de coh\u00e9rence, qui s\u2019av\u00e8re vitale pour les piliers de l\u2019Association europ\u00e9enne de libre \u00e9change (AELE) et de l\u2019Union europ\u00e9enne. L\u2019analyse est ainsi centr\u00e9e autour de deux axes de r\u00e9flexion\u00a0: les formes et le contenu mat\u00e9riel du dialogue. Dans un premier temps, il importe d\u2019identifier tant les \u00e9l\u00e9ments de l\u2019encadrement institutionnel du dialogue que les interactions spontan\u00e9es entre juges. Dans un deuxi\u00e8me temps, l\u2019analyse du contenu fait appara\u00eetre un dialogue constructif qui contribue \u00e0 la poursuite de l\u2019homog\u00e9n\u00e9it\u00e9 mat\u00e9rielle et proc\u00e9durale au sein de l\u2019EEE, ainsi qu\u2019au renforcement de la protection des individus et des droits fondamentaux. Le dialogue juridictionnel s\u2019av\u00e8re ainsi un \u00e9l\u00e9ment essentiel du dynamisme du syst\u00e8me juridique de l\u2019EEE.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Abstract<\/strong><\/p>\n<p>This contribution treats the interactions between the two judicial pillars of the European Economic Area (EEA) under the prism of the generic notion of judicial dialogue. It aims to measure the effectiveness of judicial dialogue as a guarantor of consistency, which proves vital for the pillars of European Free Trade Association (EFTA) and European Union. The analysis is thus centred around two axes of thought. One turns on the forms of the dialogue by identifying both the institutional framework of the dialogue and the spontaneous interaction between judges. The other turns on the material content of the dialogue. Content analysis shows the existence of a constructive dialogue that contributes to material and procedural uniformity within the EEA and to strengthening the protection of individuals and fundamental rights.
