Relativement jeune, cette juridiction va d\u00e9velopper une pratique consistant \u00e0 recourir \u00e0 la jurisprudence de son homologue europ\u00e9en dans la prise de ses d\u00e9cisions. Prot\u00e9iformes et aux contenus vari\u00e9s, ces diff\u00e9rentes r\u00e9f\u00e9rences \u00e0 la jurisprudence de l\u2019UE apparaissent d\u2019une part, comme la cons\u00e9quence de la parent\u00e9 syst\u00e9mique qui relie l\u2019Union europ\u00e9enne \u00e0 l\u2019UEMOA, et d\u2019autre part, comme l\u2019expression d\u2019un besoin naturel de l\u00e9gitimation de la part du juge ouest-africain. N\u00e9anmoins, afin de tenir compte des sp\u00e9cificit\u00e9s de l\u2019UEMOA et \u00eatre mieux canalis\u00e9es, ces \u00ab\u00a0importations jurisprudentielles\u00a0\u00bb se doivent de servir avant tout une politique jurisprudentielle propre \u00e0 la Cour de justice de l\u2019UEMOA et une interpr\u00e9tation autonome du droit communautaire ouest-africain.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Abstract<\/strong><\/p>\n<p>Inspired from the Court of Justice of the European Union, the Court of Justice of the WAEMU is the main judicial body created in order to guarantee the \u00ab\u00a0respect of the law concerning the interpretation and the application of the treaty\u00a0\u00bb inside the West african economic and monetary Union. Comparatively young and with a short experience, this jurisdiction has developed a practice consisting into references to the case law of his Counterpart of Luxembourg during the elaboration of its judgments. Multiform and various, these references appear to be on the one hand the result of the systemic kinship between the European Union and the WAEMU and on the other and, the expression of a natural need of legitimating from the west african judge.
