En effet, l\u2019analyse de la jurisprudence ouest-africaine montre que l\u2019influence de la CJCE se manifeste par sa jurisprudence qui constitue une source d\u2019inspiration pour l\u2019interpr\u00e9tation du droit ouest-africain. Cette r\u00e9alit\u00e9 d\u00e9coule de la similitude du raisonnement juridique, plus pr\u00e9cis\u00e9ment des m\u00e9thodes d\u2019interpr\u00e9tation utilis\u00e9es par le juge de l\u2019UE et le juge ouest-africain. En effet, le recours aux m\u00e9thodes dynamiques beaucoup d\u00e9velopp\u00e9es par la CJCE, notamment, la m\u00e9thode syst\u00e9matique, t\u00e9l\u00e9ologique, a contribu\u00e9 \u00e0 l\u2019\u00e9volution des r\u00e8gles des Trait\u00e9s, faisant du juge ouest-africain, un artisan du processus d\u2019int\u00e9gration. Par ailleurs, l\u2019influence de la jurisprudence de la CJCE se manifeste par l\u2019adoption de solutions identiques. Dans cette d\u00e9marche, plut\u00f4t que de fonder sa solution sur un raisonnement juridique, le juge ouest-africain se contente d\u2019appliquer une solution d\u00e9gag\u00e9e par la CJCE. Certes, la reprise des solutions de la CJCE mais elle ne devrait pas se faire au d\u00e9triment de l\u2019autonomie d\u2019interpr\u00e9tation du juge ouest-africain. En plus, la justification de la solution adopt\u00e9e s\u2019av\u00e8re n\u00e9cessaire afin d\u2019accorder \u00e0 celle-ci une autorit\u00e9 convaincante. Ainsi, le recours aux arr\u00eats de la CJCE devrait se faire avec prudence. Les solutions fournies par les juges devraient \u00eatre en ad\u00e9quation avec la lettre et l\u2019esprit des Trait\u00e9s des organisations d\u2019int\u00e9gration ouest-africaines.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Abstract<\/strong><\/p>\n<p>Being in an intitutional and normative environment assimilable to the one of CJEC, the judge of West Africa didn\u2019t hesitate to refer to the CJEC case law in order to interpret the community right. In fact, the examination of West Africa case law shows that the CJEC influence manifests by it case law. This helps to interpret the West African law. That reality comes from the legal resemblance, exactly from the interpretation methods used by the judge of EU and the judge of West Africa. In fact, the use of dynamic methods developped by the CJEC, mainly the systematic method or the teleological method, contributed to the evolution of treaties rules. This situation allows to the judge of West Africa to be an actor of the integration process. Moreover, the influence of the CJEC case law manifests by the adoption of similar solutions. In this way, instead of establishing his solution on a legal logic, the judge of West Africa, only, applies a solution produced by the CJEC. Indeed, the use of the CJEC solutions is not a problem but, the use would\u2019nt have to do in the place of the free interpretation of the judge of West Africa. Also, the fact to justify the solution adopted is necessary to give to this an eloquent authority. Thus, the use of CJEC decisions would have to do with delicacy.
